Acuerdo de licencia de usuario final (EULA)
1. Acuerdo entre tú y Mercurium
Este Acuerdo de Licencia de Usuario Final (en adelante, "EULA") se celebra entre tú (el "Usuario") y Mercurium ("Mercurium", "nosotros"), titular de la aplicación móvil Alma (la "Aplicación").
Al descargar, instalar o utilizar la Aplicación aceptas quedar vinculado por este EULA. Si no estás de acuerdo, no la utilices y elimínala de tu dispositivo.
2. Concesión de licencia
Mercurium te concede una licencia personal, intransferible, no exclusiva, revocable y limitada para instalar y utilizar la Aplicación en cualquier dispositivo Apple que poseas o controles, de conformidad con las Reglas de uso del App Store.
3. Restricciones
No puedes:
- Copiar, modificar o crear obras derivadas de la Aplicación, salvo en la medida permitida por la ley.
- Realizar ingeniería inversa, descompilar, desensamblar o intentar extraer el código fuente.
- Sublicenciar, alquilar, vender o transferir la Aplicación.
- Eliminar avisos de propiedad intelectual o marcas registradas.
- Usar la Aplicación para crear un producto competidor o entrenar modelos de IA de terceros.
4. Suscripciones de pago
La Aplicación ofrece acceso principal mediante suscripción Premium de renovación automática (p. ej. mensual o anual). El pago se realiza a través de tu cuenta de Apple (In-App Purchase). Las suscripciones se renuevan automáticamente salvo cancelación con al menos 24 horas de antelación al fin del periodo. La gestión y cancelación se realiza desde Ajustes > Apple ID > Suscripciones o apps.apple.com/account/subscriptions.
Eliminar tu cuenta dentro de la Aplicación no cancela la suscripción de Apple; debes cancelarla en los ajustes de tu Apple ID para evitar nuevos cobros.
Las condiciones detalladas de las suscripciones, incluidos precios, duración y política de reembolso, están disponibles en los Términos y condiciones y dentro de la propia Aplicación antes de la compra.
5. Privacidad
El tratamiento de tus datos personales se rige por nuestra Política de privacidad, que forma parte de este EULA por referencia.
6. Mantenimiento y soporte
Mercurium es el único responsable de prestar mantenimiento y soporte de la Aplicación. Apple no tiene ninguna obligación de prestar servicios de mantenimiento o soporte. Para soporte, contacta con mercuriumai@gmail.com.
7. Garantía
Mercurium ofrece la Aplicación "tal cual", sin garantías expresas o implícitas más allá de las exigidas por la ley. En caso de incumplimiento de cualquier garantía aplicable, podrás notificarlo a Apple, quien te reembolsará el precio de compra de la Aplicación si procede; en la máxima medida permitida por la ley aplicable, Apple no tendrá ninguna otra obligación de garantía respecto de la Aplicación. Cualquier otra reclamación, pérdida, responsabilidad, daño, coste o gasto será exclusivamente responsabilidad de Mercurium en los términos de este EULA.
8. Reclamaciones de productos
Mercurium, no Apple, es responsable de atender las reclamaciones del Usuario o de terceros relacionadas con la Aplicación o con el uso o posesión de la misma, incluyendo, entre otras: (i) reclamaciones de responsabilidad por producto; (ii) reclamaciones de que la Aplicación no cumple con cualquier requisito legal o normativo aplicable; y (iii) reclamaciones derivadas de la legislación de protección al consumidor o normativa similar.
9. Derechos de propiedad intelectual
En caso de reclamación de un tercero alegando que la Aplicación o tu posesión y uso de la Aplicación infringe derechos de propiedad intelectual de dicho tercero, Mercurium, no Apple, será el único responsable de la investigación, defensa, resolución y descargo de cualquier reclamación de infracción de propiedad intelectual.
10. Cumplimiento legal
Declaras y garantizas que (i) no te encuentras en un país sujeto a embargo del gobierno de EE. UU. o designado como país que apoya el terrorismo, y (ii) no figuras en ninguna lista de partes prohibidas o restringidas del gobierno de EE. UU.
11. Apple como tercero beneficiario
El Usuario y Mercurium reconocen y aceptan que Apple Inc. y sus filiales son terceros beneficiarios de este EULA y que, una vez que el Usuario acepte los términos y condiciones del mismo, Apple tendrá derecho (y se considerará que ha aceptado dicho derecho) a hacer cumplir este EULA contra el Usuario en calidad de tercero beneficiario.

End User License Agreement (EULA)
1. Agreement between you and Mercurium
This End User License Agreement (the "EULA") is entered into between you (the "User") and Mercurium ("Mercurium", "we", "us"), owner of the Alma mobile application (the "Application").
By downloading, installing or using the Application you agree to be bound by this EULA. If you do not agree, do not use it and delete it from your device.
2. Licence grant
Mercurium grants you a personal, non-transferable, non-exclusive, revocable and limited licence to install and use the Application on any Apple device that you own or control, in accordance with the App Store Usage Rules.
3. Restrictions
You may not:
- Copy, modify or create derivative works of the Application, except to the extent permitted by law.
- Reverse engineer, decompile, disassemble or attempt to extract the source code.
- Sublicense, rent, sell or transfer the Application.
- Remove intellectual property notices or trademarks.
- Use the Application to create a competing product or to train third-party AI models.
4. Paid subscriptions
The Application provides primary access through an auto-renewing Premium subscription (e.g. monthly or annual). Payment is made through your Apple account (In-App Purchase). Subscriptions renew automatically unless cancelled at least 24 hours before the end of the period. Manage and cancel in Settings > Apple ID > Subscriptions or apps.apple.com/account/subscriptions.
Deleting your account inside the Application does not cancel the Apple subscription; you must cancel it in your Apple ID settings to avoid further charges.
Detailed subscription terms, including prices, duration and refund policy, are available in the Terms of Service and inside the Application before purchase.
5. Privacy
Processing of your personal data is governed by our Privacy Policy, which is incorporated into this EULA by reference.
6. Maintenance and support
Mercurium is solely responsible for providing maintenance and support for the Application. Apple has no obligation to furnish any maintenance or support services. For support, contact mercuriumai@gmail.com.
7. Warranty
Mercurium provides the Application "as is", without express or implied warranties beyond those required by law. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application if applicable; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application. Any other claims, losses, liabilities, damages, costs or expenses will be Mercurium’s sole responsibility under this EULA.
8. Product claims
Mercurium, not Apple, is responsible for addressing claims of the User or any third party relating to the Application or the User’s possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
9. Intellectual property claims
In the event of any third-party claim that the Application or the User’s possession and use of the Application infringes that third party’s intellectual property rights, Mercurium, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
10. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Apple as third-party beneficiary
You and Mercurium acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
